License policy & restrictions
ULB/VUB END-USER AGREEMENT
This document is an end-user licence agreement or 'EULA' between the user (either an individual or a service department) and the 'Brussels Free University Computing Centre', abbreviated as 'BFUCC' in the text below. The purpose of this EULA is to cover the 'software delivery policy, general licence restrictions & general usage conditions' of all the software products that can be ordered via the 'Softweb' system.
In the rest of this EULA, the term 'SOFTWARE PRODUCT' will be used as a reference for the ordered product.
By ordering& installing the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA, as well as by the terms of the specific licence agreement of the SOFTWARE PRODUCT you ordered. If you do not agree with this EULA, do no install the SOFTWARE PRODUCT.
a. Software Product Delivery
The BFUCC grants to you as an individual a personal and non-exclusive licence to download the SOFTWARE PRODUCT from the password protected web page using your standard VUB/ULB email login and password.
These two keys (login and password) must be kept secret, and cannot be transferred, rented by or lent to any other person.
In special cases where the SOFTWARE PRODUCT is delivered on physical media such as floppy disks or cd-roms, you are allowed to take at most ONE copy for safeguard backup purposes.
Apart from performing backups, the medium may not be copied for any purpose whatsoever.
b. Software Product Installation
The BFUCC grants to you as an individual, a personal and non-exclusive licence to install ONE copy of the SOFTWARE PRODUCT on ONE computer. If you represent an entity, such as a service or department, the BFUCC obliges you to designate ONE individual within your organization who has the right to install the product in the manner explained above.
Unless explicitly stated otherwise, you cannot install a copy of the SOFTWARE PRODUCT at home.
This paragraph does not apply to special licences packages, such as SPSS 'Classroom' licences for example.
c. Software Product General Usage Condition
The BFUCC grants you as an individual, a personal and non-exlusive licence to use the SOFTWARE PRODUCT solely for educational, research or administrative purposes within the scope of your work at the ULB/VUB university..
You are not allowed to use the SOFTWARE PRODUCT for any other purpose, such as private use, commercial third party profit, etc.
Unauthorized usage of the SOFTWARE PRODUCT ,or any part of it, may result in civil and criminal penalties and will be prosecuted to the maximum extent possible under the law.
d. Storage and Network Use
The BFUCC grants you as an individual, a personal and non-exclusive licence to keep ONE copy of the SOFTWARE PRODUCT (that you downloaded from Softweb) on your storage device such as your hard disk, but solely for safeguard backup purposes.
You must be aware that keeping a safeguard backup of the SOFTWARE PRODUCT can take a large amount of disk space.
When performing regular backups of your hard disk, you are allowed to include your unique SOFTWARE PRODUCT safeguard backup copy as well.
You may install the SOFTWARE PRODUCT on the storage device of a network server, used only to run the SOFTWARE PRODUCT from your other computers over a internal network.
However, you must acquire a dedicated licence for each separate computer on which the SOFTWARE PRODUCT is installed or run from the server's storage device.
One licence for the SOFTWARE PRODUCT may not be shared or used concurrently on different computers.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
Unauthorized reproduction, distribution of this program, or any portion of it, may result in severe civil and criminal penalties and will be prosecuted to the maximum extent possible under the law.
All title, logo or parts of the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, source libraries, sample codes or examples, etc) are copyrighted by the software supplier, i.e. the company which is the owner of the SOFTWARE PRODUCT.
Unless explicitly stated otherwise, the licence you are granted to run and use the SOFTWARE PRODUCT, is time limited for a period which is usually annual.
Once this period is over, you will have to renew your licence by paying a licence renewal fee.
You will be informed by mail one month before the expiration of your licence.
If you choose to not renew your licence, you will have to remove the installed SOFTWARE PRODUCT, destroy your safeguard backup copy and all component parts of the SOFTWARE PRODUCT.
Unless explicitly stated otherwise, the licence you have obtained to download, install and use a SOFTWARE PRODUCT implies that you are eligible to receive without any furher cost any software upgrade for this product during the time limited period of your licence.
A 'SOFTWARE PRODUCT upgrade' includes improvements and corrections of the current product release, sometimes referred to as 'patches'. New releases with added features are not covered in such an upgrade.
Unless explicitly stated otherwise, the licence you have obtained to download, install and use a SOFTWARE PRODUCT does NOT imply that you are eligible to receive for free any newer version of the same software package during the time limited period of your licence.
A new version of the same software package is considered to be a different package, which must be ordered separately.
A 'new version of the SOFTWARE PRODUCT' refers to a completely new release with added features or functionalities, and a higher version number.
This is not a SOFTWARE PRODUCT upgrade.
a. Limitations on Reverse Engineering, Decompilation, and Disassembly.
You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT.
b. Separation of Components.
The SOFTWARE PRODUCT is licenced as a single product. Its component parts may not be separated for use on more than one computer.
You may not rent, lease, or lend the SOFTWARE PRODUCT.
d. Support Services.
Unless explicitly stated otherwise, the BFUCC, by means of the 'User Support Group', will provide support for the SOFTWARE PRODUCT installation and specific problems related to products shortcomings.
The 'User Support Group' will NOT provide support for normal daily use of the SOFTWARE PRODUCT.
Without prejudice to any other rights, the BFUCC may terminate this EULA if you fail to comply with its terms and conditions.
In such an event, you will have to remove the SOFTWARE PRODUCT from your computer, and destroy your safeguard backup copy of the SOFTWARE PRODUCT and all of its components parts.
To the maximum extent permitted by applicable law, in no event shall the BFUCC or the SOFTWARE PRODUCT supplier be liable for any special, incidental, indirect or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT, even if the BFUCC has been advised of the possibility of such damages.
The only obligation of the BFUCC, in pursuance of any disposition of this agreement, will be limited to the amount paid by the user for the specific SOFTWARE PRODUCT.
